To equip participants with the necessary knowledge, understanding, and practical skills to effectively manage investigations towards their conclusion, make appropriate and justifiable disposal decisions, and prepare high-quality, compliant case files for submission to the Crown Prosecution Service (CPS) or for other forms of disposal, adhering to national standards and legal requirements.

Understand Case File Standards: Explain the purpose, structure, and content requirements of different types of investigation case files (e.g., MG series forms) according to National File Standards (NFS) and local policies.

Evaluate Evidential Sufficiency: Critically assess the evidence gathered in an investigation to determine if it meets the required threshold for various disposal options, including the Full Code Test for prosecution.

Apply Disposal Options: Identify and appropriately apply the full range of available disposal options (e.g., No Further Action (NFA), Community Resolution, Simple Caution, Conditional Caution, Charge) based on evidence, offender history, victim considerations, and public interest factors.

Justify Decisions: Clearly articulate and document the rationale behind disposal or prosecution decisions, ensuring transparency and accountability.

Comply with Disclosure Duties: Understand and apply the principles of the Criminal Procedure and Investigations Act 1996 (CPIA), including identifying relevant material, completing disclosure schedules (MG6 forms), and managing sensitive material.

Prepare Prosecution Files: Compile a comprehensive, accurate, and timely case file suitable for submission to the CPS, ensuring all necessary documentation, evidence, and schedules are correctly included and formatted.

This comprehensive course addresses the vital processes involved in concluding investigations, ensuring that actions taken are appropriate, justified, and properly documented. It bridges the gap between evidence gathering and the final outcome, whether that be a non-prosecution disposal or progression through the criminal justice system.
Participants will delve into the structure and requirements of investigation case files, learning how to organise evidence, statements, reports, and administrative documents according to the National File Standard (NFS) and utilizing the standardised MG form system. The course emphasizes the importance of file quality, accuracy, and completeness as the foundation for sound decision-making.
A significant focus is placed on the decision-making process. Attendees will explore the full spectrum of disposal options available, from 'No Further Action' to various out-of-court disposals (like cautions and community resolutions) through to charging decisions. They will learn to critically evaluate the strength of evidence against relevant thresholds, including the CPS 'Full Code Test' (Evidential Stage and Public Interest Stage), considering victim perspectives and offender accountability. Justifying and recording these decisions accurately is a key skill developed.
